I think he had a used textbook in highschool civics class that was missing the pages on checks and balances and the 1st amendment.

I understood his remarks as stating that the courts are not acting judicially, that is they are acting on agenda that does not acurately execute the letter of the law. I rewrote that sentence 3 times and still don't think it says what I'm trying to say. For the way I interpret Ashcroft's remarks, I agree with him.

edit: Forgot to say that I'm also in support of the the Justice Dept's action in seeking to overturn Judge Robertson's decision on Hamdan. I do not think the Geneva Convention should apply to terrorists.
